Rosters in hotel, restaurant and leisure services

Rosters must indicate details such as the names of employees, the start and end times of working days, and days off over a three-week period. A roster must be displayed no later than one week prior to the beginning of the three-week period concerned. Each three-week period always starts on a Monday. Once displayed, a roster must not be changed without the consent of the employees and the employer. Rosters must always be drawn up by means other than a pencil.

A three-week period includes a maximum of 15 working days. For each week of five working days, employees earn two days off: a weekly rest day (‘V’) of a minimum of 30 hours, which must be given for each full week of work, and an additional day off (‘X’) of a minimum of 24 hours, which may be postponed from one week to another within the same three-week period.

In addition, the sector is governed by various provisions on working hours applicable to full-time employees, which the employer must observe when drawing up rosters.
If amending a roster results in overtime (such as in the event that a co-worker becomes ill), employees are not obliged to consent to this.
If the employer requires additional employees for duties suitable for existing part-time employees, such work must be offered even after displaying the roster.
Inexpediently short shifts should be avoided. No shifts of less than 4 hours may be used, except where required by an employee’s needs or for some other justified reason.
